The use and or selling of drugs by any occupants will result in immediate eviction. all pertinent information will be given to interested parties such as Section 8 and the Asheville Police Department.
No tenant shall smoke, nor permit anyone to smoke in the Tenant's house or apartment. Smoking is prohibited throughout the entire complex including but not limited to hallways, stairways, foyers, common rooms and facilities, decks, patios, exterior landings, front steps, entrance ways, roof tops, fire escapes, basements, storage areas, parking areas, driveways, walkways, lawns, gardens, adjoining grounds and building facilities. Designated smoking area: The forgoing rule notwithstanding the landlord may but is not required to designate an area for smoking provided the designated area is located outside of and away from any building or other location where secondhand smoke might drift back into the building. Tenant acknowledges that the designated smoking area may be relocated from time to time or eliminated entirely at any time during the lease term. The term smoking is defined as inhaling, exhaling, burning of a tobacco product or medical marijuana or carrying any lighted cigarette, cigar, pipe, hookah, or using other smoking devices and any manner or form including electronic cigarettes or e-cigars and vaporizes. Notwithstanding this rule, the Landlord is not a guarantor of a smoke-free or tobacco-free environment.
Use of premises. The premises shall be used and occupied by Tenant(s), and authorized occupants, as a private individual dwelling, and no part of the premises shall be used at any time during the term of this agreement by tenant(s) for the purpose of carrying on any business, profession, or trade of any kind, or for any purpose other than private dwelling. Tenant(s) shall not allow any other person not on the least stay/reside at the property, unless authorized in the agreement or otherwise authorized in writing by the Landlord. Landlord may also increase the rent at any such time as a new tenant, or authorized occupants is added to the leased premises. Tenant(s) are responsible for the conduct of their authorized occupants and guests. Tenant(s) and guests shall comply with any and all laws, ordinances, rules and orders of any and all governmental or quasi-governmental authorities affecting the cleanliness, use, occupancy and preservation of the premises
Tenant is responsible for putting furniture pads under furniture legs to prevent scratches and indentations in the flooring. Scratches or indentations in flooring that require repair or refinishing will be done at the Tenant's expense.
Parties, children, and gatherings are to be taken inside after 10:00 p.m. Quiet should be maintained at all hours of the day and night. Loud parties or any other kinds of disturbances will not be tolerated. This applies to all Tenants, authorized occupants and guests.
Heaters that have a flame or require fuel are strictly prohibited. Grills shall not be used within 10 feet of the building.
You must have written approval from Resolve Property Management, LLC before installing a satellite dish on the property. No satellite dish is allowed on or attached to any house. The technician should not drill or puncture through the side of the house nor any other intrusion from the outside of the house into the inside.
No automobile repair is allowed on the property. This includes oil and any other changing of fluid. Cars without a tag and/or inoperable vehicles are subject to be towed.
Tenant stickered parking only. All automobiles must have a parking sticker on the vehicle. Automobile registration must be turned into the landlord. Guests are not allowed to keep their vehicle on the property. Only one parking pass is allowed per unit. If a tenant needs a new sticker due to loss of sticker, vehicle, or any other reason; the tenant will be charged $25 for the processing of that new parking pass. Tenant is responsible for the cost of towing and impoundment if the car owned or leased by the tenant does not have a parking sticker, if the tenant has more than one car on the property, or if the vehicle on the property does not have a license plate or is inoperable. All cars without an active license plate or parking sticker will be towed at the vehicle owner's expense. To retrieve your vehicle please see the sign located on the property.
Tenants are permitted to have guests visit his/her premises. However, a person making recurring visits or one continuous visit of 14 days or more within one year lease term, must apply and qualify as an authorized occupant or additional tenant on the premises. Only names listed on the lease may live on the property. If you wish to add a name to the lease, written notice must begin to resolve Property Management, LLC. and application submitted. A credit and criminal background check must be conducted immediately. Violation of this rule will result in lease termination and eviction. A tenant's guests are subject to the terms of the least, these rules, and federal state or local law. The tenant accepts full responsibility for the guests' actions while the guests are on the premises, including for any damages to the premises. Pertinent information will be given to interested parties such as Section 8 and Asheville Police Department.
No motorized scooters or any motorized toys or vehicles may be kept on the property. There are no exceptions unless approved by management and the vehicle has a parking pass.
Tenant, authorized occupants and guests are not permitted to play in and or around houses that are still being constructed. It is dangerous and could result in injury.
Maintenance requests. All maintenance requests for service and/or repairs should be made from business hours, Monday through Friday 9:00 a.m. to 5:00 p.m. using the tenant property management online portal www.resolvepm.managebuilding.com
In the event of an emergency (e.g. lack of heat, electricity and water leaks) after business hours, call 828-222-3747. Repairs as a result of intentional or negligent acts of the tenant, authorized occupants and/or guests will be charged to the Tenant.
Trash Removal. All trash must be deposited in cans or bins and placed on the street on the designated trash day. Any trash left on the street or in the yard will result in a $20 cleanup charge. All cans and bins must be removed from the street after trash is picked up on the designated trash day.
Tenants must keep an active phone number on file with the Landlord. If the tenant does not, there will be a fine of $20 per occurrence.
All verification of occupancy by third parties must be in writing and allow one week return time. If the tenant requests that the landlord complete paperwork for rental assistance, there will be in charge of $20 added to the Tenant's ledger for this service.
Tenants and guests will not use or enter the crawl space of the house or apartment.
Tenant must give a forwarding address when turning in a 'notice to vacate' or 'notice of intent to vacate' form.
Tenant agrees to use the landlord's web based property management portal, which requires the tenant to have an email account. If the tenant does not have an email they will obtain one, ensuring communication, maintenance requests and rent payments can be made and the Tenant's ledger can be reviewed. If the tenant does not have a personal computer or smartphone, the Tenant agrees to use the public library for access to this service.
Some properties require the water bill to remain in the Landlord's name. The Landlord will bill the tenant and the tenant is to pay when they receive the bill. If a tenant fails to pay the water bill, the Landlord will take court action against the tenant to recover the monies. There may be more charges added to the tenants ledger to pay for court filing fees and court costs.
If the Tenant is leasing a garage apartment, with a garage or storage space located underneath, it is ONLY for the apartment. (Finished Heated Space.) Any other use of the property is only allowed if the tenant has a lease agreement with the Landlord. Any use of the other spaces in the building, without a lease for that space, by ANYONE is a violation of the least agreement and may result in lease termination and eviction.
ANY tampering with smoke detectors, carbon monoxide detectors, or sprinkler systems will result in a lease violation and eviction and an action for recovery of damages. The only exception to this rule is for the replacement of batteries in the smoke detector.
Landlord has the right to install surveillance cameras on site outside of any and all properties for security purposes. Only the landlord, property manager and all pertinent employees thereof will have access to said footage.
No non-upholstered furniture or unsightly furniture, appliances or equipment may be placed on the grounds or exterior of the dwelling unit, including porches and yards. No hazardous materials may be kept on the premises. Without notice and at the tenant's expense, the Landlord may remove and dispose of any of the aforementioned items.
During inclement weather, including snow and ice, it is the tenants responsibility to clear his or her walkway, patio, porch, stairs and driveway.
If law enforcement is called to the Premises, this will be considered grounds for a lease termination at the Landlord's Discretion
Tenants must not change the locks, add additional locks, and/or remove locks from any exterior or interior doors without the landlord's approval. Lost keys will be replaced through the landlord, at cost. Should a tenant find him/herself locked out, there will be a reasonable service charge in line with what a local locksmith charges for service calls.. Tenants that fail to return keys to the premises at move out will be charged the cost to rekey or for the replacement of each lockset.
Tenant agrees to maintain all utility services, separately billed to the premises, as noted in the signed lease agreement, during the lease term. Failure to maintain Utility Services will result in a lease violation and eviction.
All fees charged to the Tenant's account are considered due and payable at the time they are placed on the Tenant's ledger. All unpaid balances are subject to court action per the terms of the lease.
Landlord will not share security camera footage or the findings therein with the tenant.
Landlords and their Property Manager hold no responsibility for lost or stolen packages.
Any and all overpayment on Tenant ledgers will be credited towards future rent. There will be no refunds for overpayments.
All Tenants must provide yearly income verification for the purposes of ensuring compliance at income restricted properties.
Tenants are not to alter the property in any way. Tenants are not to put holes in the walls for the purpose of hanging decorations, TV mounts, or any other reason. Tenants are not to affix any stickers or wall paper to the interior or exterior of the property.
Each Lease/Residence is allotted only one parking pass. Unless otherwise notified, all guests are to park off site. If a Tenant requires a new parking pass due to a change in vehicle or lost parking pass, the old parking pass will become void and a processing fee of $25 will be placed on the tenant ledger, due and payable immediately.
All residents and their children will remain clear and away from all mowers and other lawn maintenance personnel and activities.
Bulk Items: Trash cans and dumpsters are intended for regular household trash only. Bulk items such as furniture, mattresses, and electrical appliances are to be disposed of, off the premises at the tenant's expense. If the Landlord or Property Management Staff has to come and remove bulk items from the premises, the Tenant will be charged at a commensurate rate.
Landlord holds no responsibility for pests which enter the unit after the Tenant's lease begins. Pest removal of, including but not limited too, cockroaches, bedbugs, ants, mosquitoes and flies are the tenant's responsibility. The Tenant may call their own pest control service or ask the Landlord to hire a pest control service. Tenants must pay the estimated cost of the pest control service through the property management portal before the Landlord in turn sends out the service provider.
Any labor required of Resolve Property Management which arises from Tenant's negligence or omissions will be charged to that tenant at a rate of $150 per hour.
No residents or their guests are to park in the grass, yard or in front of the dumpster/trash service area. All vehicles belonging to the tenant or guests must park on the street or in designated parking areas such as driveways or concrete/gravel parking areas. Any damage to the yard, grass or lawns will be charged to the tenant. Any amount charged by trash collection service for obstructions to the dumpster will be forwarded to the party/tenant/guest responsible for the obstruction.
All fees and fines placed on a Tenant's account are due and payable at the point in time the account is charged.
All non-emergency maintenance work will be performed between 8:00 AM and 3:00 PM, Monday through Friday. In the event that maintenance work is required to rectify any hazardous condition that could affect the safety of the unit or its occupants, this work will be scheduled and carried out immediately, whether or not the resident is present.
Any damage caused by unreported maintenance issues must be reported to Resolve Property Management through the resident portal as soon as discovered. If not, the repair costs will be added to the tenant's ledger and will be due immediately.
